Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the http://www.artemislondon.com website operated by Artemis London.


Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.


By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.


Purchases


If you wish to purchase any product or service made available through the website, you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, address and contact number. These details are stored securely and will be shared only with the shipping company who will deliver your purchase.

The products on the Artemis London website are all handmade and should be treated as you would treat other pieces of furniture. They will degrade over similar timeframes and because of their raw nature will differ from the photos used on the Artemis London website to represent them. The raw nature of our furniture, such as the wood, is sold as described and any number of the descriptions of our wood could appear in your purchase. By buying through us you accept these characteristics of the wood, these characteristics of the wood do not amount to a fault in the furniture and returns may not be accepted on this basis after the elapsed 14-day period after receiving your goods. The wood could cause minor injury, such as wood splinters, due to its raw nature and we do our best to give a clean and safe finish to all of our products before sending them out to you. The cracking and/or warping of wood due to extreme changes in room humidity or direct heat source (air conditioning and radiators) is excluded as a fault in the furniture

After purchasing we will make the furniture you have requested. We can then send you photos of your furniture and then ship them out to you. On delivery, you will have an opportunity to see your purchase and you can decide whether to accept the products as seen. At any point during this phase, you are free to cancel your order and have no obligation to accept the delivery and can send it back with the shipping company free of charge for a full refund or a remake of the products. If you would like to send back your products after this phase, after accepting delivery, it is our discretion on whether to accept this based on the issues you have and the circumstances and the amount of time elapsed. Returns postage is not paid by us after accepting delivery if the goods are not faulty.

Artemis London reserves the right to limit the quantity of items purchased per person, per household or per order for any reason. We also reserve the right to cancel your order. These restrictions may apply to orders placed by the same payment method, the same PayPal account/debit/credit card, and also to orders that use the same billing and/or shipping address. We will notify you should such limits be applied.

Delivery

Your order must be paid in full prior to delivery. It is not possible for the delivery staff to take payments on our behalf, only the furniture set up fee or UK wide delivery payment may be paid directly to them.

Changing an order may cause a delay with your delivery time and may alter the price you have been quoted.

Please note, all delivery dates and lead-times quoted are given in good faith and are approximate at the time of placing your order based on the estimated length of time that we believe we can make and deliver the order to you based on stock levels and/or delivery times. The times provided by us are supplied in good faith and the making of your goods may be affected by mistakes or delays that are beyond our control and therefore we cannot accept responsibility for any consequential loss. As such variations may occur. Where multiple items have been ordered, we will endeavour to deliver them all together before the longest delivery time quoted, unless a split delivery is specifically requested. A requested split delivery will be subject to a further delivery charge. If the circumstances of your order change, we will contact you.

Our delivery drivers always do their best to deliver your order within the allocated time-frame given to you, particularly in London, this time-frame can be subject to delays because of traffic beyond our control therefore we cannot accept responsibility for any consequential loss from a delay.

Where applicable, our expert Delivery Service team will carefully install your new furniture in your home, exactly where you want it (subject to access). Please make sure that the areas you want the furniture placed are cleared. Unless this service is paid for, all items require customer self-assembly and/or installation Self-assembly items will be delivered to the room of your choice. It is your responsibility to remove the product from the packaging and assemble. Although, you may not be able to assemble the product immediately, please fully check the product and in the unlikely event of any product being damaged or parts missing, please advise within 72 hours of delivery.

To make sure you are completely satisfied with your furniture the delivery team will ask you to sign for your furniture, all deliveries must be pre-booked and must be signed for. 

Refurbished items as sold with issues and free returns or replacements based on these issues outlined before purchase are not accepted.

The below points are for refurbished pieces only:

Condition of Goods: All refurbished pieces are second-hand and may contain minor imperfections consistent with prior use, which do not affect the structural integrity or aesthetic quality of the furniture.

Repairs and Modifications: Structural repairs or modifications may have been made to the pieces, including the addition of new wood or components, to restore functionality or improve design.

Handcrafted Finishes: Each piece is stripped, painted, waxed, and fitted with new handles by hand, which may result in slight variations in colour, texture, or finish.

Non-Returnable Items: Refurbished furniture is sold “as-is” and is non-returnable unless proven to be defective beyond described wear, repairs and normal expectations.

Custom Variations: Any customisation or alteration requests must be agreed upon before purchase, and may affect lead times and pricing.

Warranty Limitations: Warranty is limited to structural repairs made during the refurbishment process. Natural wear or deterioration post-sale is not covered.

Care and Maintenance: Customers are responsible for proper care and maintenance, including avoiding exposure to extreme heat, moisture, or harsh chemicals that may damage the finishes.

Fit for Purpose: While all efforts are made to ensure the chest of drawers are functional, customers must ensure the size and style are suitable for their intended use prior to purchase.

Liability for Damages: The seller is not liable for any damage or injury caused by misuse or improper care of the refurbished furniture after it is delivered.

Final Sale: All sales are final, and refunds or exchanges will not be provided unless the item is significantly not as described or faulty due to seller error

Returns

Under the Consumer Rights Act of 2015, you are entitled to cancel your contract, but only if you exercise this right no longer than 14 days after the day on which goods are received. This is the statutory cooling off period. After this period has expired there is no right to cancel. Item(s) cannot be returned or cancelled after the 14-day cooling off period unless the item is confirmed as being defective.

The 14 days cooling offer period is an opportunity to help you to inspect the goods and to verify your choice without the benefit of seeing the furniture prior to purchase. As such it is not a period where you can or should make normal use of the furniture, the furniture must be ‘as new’ condition. We may require an additional payment from you to reflect the deterioration in the condition of the furniture since it has been in your home and to reflect that the item will be ‘returned stock’. The payment will be evaluated on a case by case basis and will be advised at point of cancellation.

Under UK law, the statutory cooling off period has certain exclusions:
i. Bespoke items. These are goods that have been ordered to the unique and exact specifications of a customer. Simply selecting a colour from a range of colours available or your product being made to order does not make your furniture bespoke under this clause.
ii. Self-assembly items that have been damaged during assembly.

Bespoke and customised goods are not subject to cancellations rights under Consumer Rights Act.

Bespoke Items: If you have ordered a bespoke item, we will give a full refund if we have not yet started the work. As it is a personalised item, we cannot refund in full once we have started the work on your order. The amount of refund will be judged on the extent of the project which has been undertaken and the amount of resources already allocated. This will be judged on a case by case basis.

All orders purchased through the ‘Design Your Own Table’ page are bespoke and fall into these refund terms.

In order to exercise the right to cancel, you must inform us in writing via email including your order number as part of your correspondence.


Your Cancellation is effective from the date you send us the email.

If you decide to cancel after receipt of the item(s), it is your responsibility to return the goods to us at your own cost and in new condition. You are the owner of the furniture once it has been delivered to you. Once the delivery has been accepted, the outgoing delivery cost will be subtracted from the refund amount. Failure to take reasonable care of the Goods may result in a claim against you. To minimise this risk, please ensure that you pack the Goods appropriately when you return them to us to prevent any damage during transportation. Alternatively, we do offer a collection service if you are unable to return your items. We charge a collection fee on a case by case quote based on product type, number of goods and location of collection - this will be 25% for each item returned to cover the cost of collecting the Goods, plus any claim for deterioration to condition.

This must be done within 14 days of notification of your decision to cancel the contract.

Content


Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the dissemination of this content once it has been taken from our website and we are not held responsible for how this content is used.

We try to present accurate information on our website at all times. There may be occasions when information on www.artemislondon.com may contain typographical errors or other inaccuracies. Any such errors are wholly unintentional and we apologise if information in any way affects your individual order.

We present our website content “as is” and make no claims as to its accuracy, either expressed or implied. We reserve the right to amend errors, or to update product information at any time, without prior notice.

By using the service, you agree that you will not attempt to undermine the integrity of this website.

Customer agrees that use of the service is entirely at customer's own risk. Services are provided as is, without warranty of any kind, either express or implied, including without limitation any warranty for information, services or uninterrupted access, or products provided through or in connection with the service, including without limitation the software licensed to the customer and the results obtained through the service. Specifically, we disclaim any and all warranties, including without limitation: 1) any warranties concerning the availability, accuracy or content of information, products or services, and 2) any warranties or title or warranties of merchantability or fitness for a particular purpose. 

This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay of operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. Customer specifically acknowledges the service is not liable for the defamatory, offensive or illegal conduct of other customers or third parties and that the risk of injury from the foregoing rests entirely with customers.

Neither the service nor any of its agents, affiliates or content providers shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the service or inability to gain access to or use the service or out of any breach of any warranty. Customer hereby acknowledges that the provisions of this section shall apply to all content on the service.

Artemis London has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Artemis London shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.


Changes


We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days days' notice prior to any new terms taking effect if you have an order placed with us during the transitional period and are yet to receive your goods. What constitutes a material change will be determined at our sole discretion.

Definitions

Raw wood - this is wood which is in its pure state, unprocessed and unmixed with other materials. 100% wood.

Wide-stave wood: the standard depth of the wood used on the majority of the furniture is 21-22cm wide. This depth runs the entire length of the pieces of furniture.

Wood movement: the difference between the moisture content of the wood and the moisture content of the surrounding air

Ridges: this refers to a difference in height between wood joins

Splits: sections of the wood where the wood has begun to divide

Cracks: section of the wood where the wood has divided top to bottom

Knots: dark rings, circles along the wood grain where the branches of the tree were

Wood grain: the pattern of fibres seen in the cut wood

Kiln-dried wood: the drying process of wood, bringing it down to 8-12% moisture for indoor suitability

Wood character: please note that the furniture is made from natural timber, and it may will variations in appearance. These include the frequency and size of knots and cracks, consistency of colour between table top pieces, and the waviness, warp, angle, and colouring of the wood. The wood is as accurately represented as possible in relation to these variations through the sales process/website. Descriptions, photos and videos are available on the website. If you have specific needs or concerns regarding these natural variations, please ensure they are included in your order or contact before confirming your order.
